General terms and conditions governing the purchase of Optiheart products through our official websites in the European Union and partner countries.

These Terms & Conditions ("Terms") govern the contractual relationship between Optiheart EU ("we", "us", "our", "Seller") and any natural person acting as a consumer ("Customer", "you") who places an order through our official websites, including optiheart.eu and its country-specific subdirectories for the Czech Republic, Greece, Portugal, Spain, Slovakia, Italy, Germany, Lithuania, Austria, Cyprus and Colombia.

By placing an order, you confirm that you have read, understood and accepted these Terms in their entirety.

1. Introduction

These Terms are governed by the laws of the European Union, in particular:

  • Directive 2011/83/EU on consumer rights.
  • Directive 2005/29/EC on unfair commercial practices.
  • Regulation (EU) 2016/679 (GDPR) on data protection.
  • Regulation (EU) No 1169/2011 on food information to consumers.
  • Applicable national consumer protection legislation in each country of sale.

2. Definitions

  • "Seller" – Optiheart EU, operating the websites optiheart.eu and its subdirectories.
  • "Customer" – a natural person acting outside their trade or profession.
  • "Product" – the food supplement Optiheart, sold in capsule form.
  • "Order" – a declaration of will by the Customer to purchase the Product.
  • "Contract" – the purchase agreement concluded between the Seller and the Customer.

3. Order Process

Orders can be placed through the order forms available on our official websites. The order process consists of the following steps:

  1. The Customer completes the order form with the required information (name, telephone number, delivery address).
  2. The Customer submits the form by clicking the order button.
  3. The Seller's operator contacts the Customer by telephone to confirm the order and delivery details.
  4. The Contract is concluded upon confirmation of the order by the Customer.
  5. The Seller dispatches the Product to the delivery address provided by the Customer.

The Seller reserves the right to refuse or cancel an order in exceptional cases, such as suspected fraudulent activity or unavailability of the Product.

4. Pricing & Payment

All prices displayed on the website are final and include applicable taxes, unless expressly stated otherwise. The price applicable to an order is the price displayed at the time of placing the order.

The available payment method is:

  • Cash on delivery – the Customer pays the courier upon receipt of the Product.

No payment is required in advance. The Seller reserves the right to change prices at any time, but such changes will not affect orders already confirmed.

5. Delivery

The Seller dispatches orders to the delivery address provided by the Customer. Delivery times may vary depending on the destination country, typically within 2 to 7 business days from order confirmation.

The Seller is not responsible for delays caused by the courier service, customs procedures or force majeure events. The Customer is responsible for providing accurate and complete delivery information.

6. Right of Withdrawal

As a consumer within the European Union, the Customer has the right to withdraw from the Contract within 14 calendar days from the date of receiving the Product, without providing any reason. 7. Warranty & Complaints

The Seller is responsible for ensuring that the Product conforms to the Contract at the time of delivery. If the Product is defective, damaged or does not match the description, the Customer may file a complaint under applicable consumer protection law.

Complaints should be submitted through our official website. The Seller will handle each complaint within the statutory timeframes and inform the Customer of the outcome.

8. Liability

The Seller makes every effort to ensure the accuracy of the information published on the website. However, the Seller is not liable for:

  • Any damage resulting from the improper use of the Product.
  • Any damage resulting from the Customer's failure to follow the product instructions or applicable legal requirements.
  • Any indirect or consequential damages arising from the use of the website.

Nothing in these Terms excludes or limits the Seller's liability for death, personal injury or fraud caused by the Seller's negligence, or any other liability that cannot be excluded under applicable law.

Important: Optiheart is a food supplement, not a medicinal product. It is not intended to diagnose, treat, cure or prevent any disease. The information on our website does not replace professional medical advice.

9. Product Information

Optiheart is a food supplement in capsule form, intended to support normal blood pressure, particularly in warm weather. The Product is intended for adults aged 18 and over. It is not suitable for pregnant or breastfeeding women or for children under 18 years of age.

Information about the composition, dosage and use of the Product is provided on the product page and in the accompanying leaflet. By purchasing the Product, the Customer confirms that they have read and understood this information.

10. Intellectual Property

All content published on the website – including text, images, graphics, logos, trademarks and software – is the property of the Seller or its licensors and is protected by copyright and trademark laws. Any reproduction, distribution or use of this content without the prior written consent of the Seller is prohibited.

11. Personal Data

The Seller processes personal data of Customers in accordance with the GDPR and applicable data protection laws. Detailed information about how personal data is collected, used and protected is available in the separate Privacy Policy.

12. Dispute Resolution

In the event of a dispute arising from or in connection with these Terms or a purchase, the Customer may:

  • Contact the Seller directly in an effort to resolve the matter amicably.
  • Submit a complaint to the relevant consumer protection authority in their country of residence.
  • Use an out-of-court dispute resolution body, where applicable.
  • Bring the matter before a competent court in accordance with applicable law.

13. Changes to These Terms

The Seller reserves the right to update or amend these Terms at any time. The applicable version is the one in force at the time of placing the order. The updated version will be published on this page with a revised effective date. We encourage Customers to review this page periodically.
